Telangana State BJP president granted Bail- Released from Jail

Hyderabad : Justice Ujjal Bhuyan of the Telangana High Court on Wednesday directed the release of BJP State president Bandi Sanjay Kumar. Earlier in the day, the judge granted permission for out of turn hearing of the matter. The court found that the very arrest was not proper and judicial remand of 14 days under epidemic act was not in order. The court issued notices to the district police why he was booked under various section and why the remand report was silent on issues listed in the FIR.

Senior counsel Prakash Reddy pointed out that the lower court did not apply its mind while ordering judicial remand of the petitioner. Even as the public prosecutor stood up to oppose the petition, Justice Bhuyan pointed out that it was not for the public prosecutor to appear for the Judicial Officer whose order did not reflect application of mind.

On the question of whether the petitioner must file a fresh petition for bail or setting aside the remand order is sufficient, the court held that it was not without power to order the release of the petitioner and accordingly ordered his release. Bandi Sanjay was released from Karimnagar jail around seven in the evening today and accused the district police to be inhuman and acting to the whims of the state Chief Minister.
